1. Acceptance of Terms

By accessing or using Ludufy (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of the Service

Ludufy enables creators to build interactive live games and audience experiences and enables participants to join those experiences and, where offered, receive prizes.

3. Eligibility and Accounts

  • You must be at least 18 years old to use the Platform.
  • You must provide accurate and current information.
  • You are responsible for activity that occurs under your account.
  • You must keep your login credentials secure.

4. Acceptable Use

You agree not to:

  • Use bots, scripts, macros, automation, or unauthorized tools
  • Create multiple accounts to gain unfair advantage
  • Exploit bugs, reverse engineer, or interfere with the Platform
  • Cheat, collude, manipulate results, or abuse prizes or rewards
  • Use the Platform in violation of law or third-party rights

5. Monitoring, Enforcement, and Prizes

We may monitor usage, gameplay behavior, device and network signals, and account activity to prevent fraud, abuse, bots, and unfair play.

  • We may investigate suspicious activity at any time.
  • We may suspend or terminate accounts for violations or suspected abuse.
  • We may deny, delay, revoke, or recover prizes where we reasonably suspect fraud, abuse, or ineligibility.
  • Prize eligibility decisions are made by Ludufy in its reasonable discretion, subject to applicable law.

6. Google APIs and YouTube API Services

Certain features of Ludufy rely on Google APIs and YouTube API Services. By connecting a Google or YouTube account or using features that depend on those services, you authorize Ludufy to access and process the data covered by the permissions you grant.

Your use of those features is also subject to the YouTube API Services Terms of Service, available at https://developers.google.com/youtube/terms/api-services-terms-of-service.

6.1 Scope-Specific Functionality

  • youtube.readonly is used to read channel and account information needed to connect channels and evaluate channel-based access restrictions.
  • youtube.channel-memberships.creator is used for creator-controlled features that depend on channel membership information, including memberships-enabled access rules.

6.2 User Responsibilities

  • You must connect only accounts you are authorized to use.
  • You must not misuse Google or YouTube features made available through Ludufy.
  • You remain responsible for complying with Google's and YouTube's applicable terms and policies.

6.3 Availability and Changes

Google or YouTube may change, suspend, or discontinue APIs, scopes, or permissions at any time. We may modify or remove related Ludufy features accordingly.

7. Third-Party Services

The Platform may integrate with third-party services, including Google, YouTube, Supabase, Vercel, and reward providers. We are not responsible for third-party services, content, or policies.

8. Intellectual Property

The Platform, including its software, design, branding, content, and underlying systems, is owned by Ludufy or its licensors and is protected by applicable intellectual property laws.

9. User Content

If you submit content through the Platform, you grant Ludufy a non-exclusive, worldwide, royalty-free license to use, host, reproduce, and display that content as needed to operate, improve, and promote the service.

10. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee uninterrupted operation, accuracy, or error-free service.

11. Limitation of Liability

To the maximum extent permitted by law, Ludufy will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from or related to your use of the Platform.

12. Suspension and Termination

We may suspend or terminate access to the Platform immediately if we believe you violated these Terms, created risk for the Platform or other users, or engaged in fraud, abuse, or unlawful activity.

13. Changes to the Terms

We may update these Terms from time to time. Continued use of the Platform after updated Terms become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of Argentina, without regard to conflict of law rules, and subject to mandatory consumer protection law where applicable.
